terms of service

1. acceptance of terms

By accessing or using PostAI (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms constitute a legally binding agreement between you and PostAI SAS, a French simplified joint-stock company (“PostAI”, “we”, “us”, or “our”) with its registered office at 15 rue de la Paix, 75001 Paris, France.

2. description of service

PostAI is a cross-platform social media management platform that provides tools for scheduling and publishing content across multiple social networks, AI-powered content generation and suggestions, a video studio for creating and editing short-form video content, and an MCP (Model Context Protocol) server enabling integration with AI assistants and third-party automation tools. The Service may be updated, expanded, or modified at our discretion with reasonable notice to users.

3. account registration & workspaces

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. PostAI organises work in “Workspaces”. A Workspace is a shared environment to which you can invite collaborators. You must be at least 13 years old to create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated.

4. subscription plans & credits

PostAI offers the following subscription tiers: Free, Starter, Creator, Pro, Pro Plus, and Agency. Paid subscriptions are billed monthly or annually and grant access to increased limits and features. AI features (content generation, caption writing, hashtag suggestions, and similar capabilities) consume credits. Credits are allocated each billing cycle according to your plan and do not roll over. Additional credits may be purchased separately. PostAI reserves the right to adjust pricing and plan features with at least 30 days notice to existing subscribers.

5. acceptable use policy

You agree not to use the Service to: send spam or unsolicited communications; harass, threaten, or harm any individual or group; publish or distribute illegal, defamatory, or infringing content; perform automated scraping beyond the limits permitted by the connected social platform's own terms of service; circumvent authentication or security measures; impersonate any person or entity; or violate any applicable law or regulation. PostAI may suspend or terminate accounts that breach this policy without prior notice.

6. intellectual property

You retain all ownership rights to the content you create, upload, or schedule through the Service (“User Content”). By using PostAI you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your User Content solely to provide the Service. PostAI and its licensors own all rights, title, and interest in and to the platform, including all software, design, trademarks, and documentation. Nothing in these Terms transfers any ownership of platform intellectual property to you.

7. privacy & data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the collection and use of your data as described therein.

8. disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. PostAI does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. limitation of liability

To the maximum extent permitted by applicable law, PostAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. In any event, PostAI's total liability to you for all claims shall not exceed the amount you paid to PostAI in the twelve months preceding the event giving rise to the claim.

10. termination

You may terminate your account at any time from your account settings. PostAI may suspend or terminate your access to the Service at any time for breach of these Terms or for any other reason with reasonable notice, or immediately where required to protect the Service or other users. Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, and 11 survive termination.

11. governing law

These Terms are governed by French law. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection laws in your country of residence require otherwise.

12. changes to terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 30 days before the changes take effect for existing subscribers. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
